Title VII of the Dodd-Frank Act provides that the SEC and the CFTC, in consultation with the Board of Governors of the Federal Reserve System, must work jointly to further define the terms “swap dealer,” “security-based swap dealer,” “major swap participant,” “major security-based swap participant” and “eligible contract participant.” In accordance with Title VII, the CFTC and SEC released an advance notice of proposed rulemaking (ANPR) and request for comments. The swaps definitions ANPR entered the Federal Register on August 20, 2010. The deadline for comments was September 20, 2010.[1]
